Individual mandate declared unconstitutional
Also this week, a U.S. District Court Judge ruled that the federal health care reform law’s individual mandate exceeds Congress' power to regulate interstate commerce. The judge also invalidated the entire law. The health care law could eventually face the Supreme Court. While some federal judges have ruled the Affordable Care Act constitutional, two now have not. The individual mandate provision is what specifically has been under fire in lawsuits, not the law in its entirety. The White House stated that plans to implement the law will continue and that the Department of Justice plans to appeal the decision.
