SB 142: "I'm Sorry" legislation
Description
- SB 142 was identical to a 2010 bill proposed by the Judicial Council based on Hawaii law which provides exclusion of statements or gestures similar to an apology or empathy in any liability lawsuit. The exclusion is not restricted to health care providers and provides that any statement implying fault may be admissible. The Senate Judiciary Committee amended the bill to to have only the admissibility of admissions of fault subject to the discretion of the trial court. A subsequent amendment was approved that does not permit the waivers of charges admissible as evidence of fault.
KMS Position
- While KMS supports legislation to make expressions of apology inadmissible in lawsuits, the uncertainty created by SB 142 will not encourage health care providers to offer such expressions of sympathy or condolences to patients.
