HB 2359: Payment for services provided to persons in custody
Description

The bill requires health care providers to accept the lesser of the actual amount billed by the health care provider or the Medicaid rate for services rendered when treating persons in custody of the State Department of Corrections (DOC) or the Juvenile Justice Authority (JJA) who are not covered by a private health care plan. The bill does not require a health care provider to render care to a person in custody and does allow the DOC and/or the JJA to enter into an alternative agreement with licensed health care provider for the provision of services.
Background

Current law allows Kansas counties, cities, county or city law enforcement agencies or a county department of corrections the ability to remit the lesser of the actual amount billed or the Medicaid rate to providers rendering treatment to persons in custody.
