HB 2069: "I'm Sorry" legislation

Description

  • This bill would make inadmissable in a legal proceeding statements and acts by a health care provider expressing regret, mistake, error, sympathy, apology, commiseration, condolence, compassion or a general sense of benevolence. The bill only applies to health care providers who are based in a hospital setting.

KMS Position

  • No position: KMS, in general, is supportive of "I'm Sorry" legislation. However, HB 2069 has been amended to the point that it no longer provides protection equally to the general community of physicians. Rather, it is limited to those physicians in a hospital setting who agree to participate in a "facilitated conference" involving representatives of the hospital administration and the patient or patient's family.
